Terms and Conditions

 

By electronically signing the online Find A Doctor (“Directory”) registration form, I acknowledge, affirm, and agree to the following terms and conditions:

1. General

The Directory is an online directory designed and maintained by the Physicians Committee for Responsible Medicine (“Physicians Committee”) to connect members of the public with health care providers in their area who promote plant-based nutrition. The Directory displays information about health care providers based on geographical information submitted by a user in conjunction with a health care provider’s claim that the health care provider promotes plant-based nutrition. All information in the Directory is submitted by the health care providers listed in the Directory. The Physicians Committee does not verify the accuracy of the information.

The Physicians Committee does not recommend or endorse any health care provider listed in the Directory. No referral relationship exists between or among the Physicians Committee and any of the health care providers listed in the Directory. Search results generated by the Directory are based on user-generated search criteria, such as location and specialty, and not on fees paid, if any, by the health care providers for listing in the Directory.

2. Material Submitted to the Directory

The Physicians Committee does not claim ownership of the material I submit (including feedback and suggestions) to the Directory or to any other Physicians Committee site or associated service. However, by posting, uploading, inputting, providing or submitting my material, I grant the Physicians Committee, its affiliated companies, and its necessary sublicensees permission to use my submitted material in connection with the operation of the Directory including, without limitation, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat my submission and to publish my name in connection with my submission. The Physicians Committee is under no obligation to post or use my submission and may remove any submission at any time in the Physicians Committee’s sole discretion.

3. Fair Market Value

The Physicians Committee will not compensate me for the use of my submission. If the Physicians Committee imposes a fee for submissions to the Directory, such fee will be a flat fee representing the fair market value of a Directory listing, as determined by an independent valuator, based only on the aggregate cost to Physicians Committee of operating the Directory. Such fee will be the same for all health care providers and will not take into consideration any potential business generated for health care providers through the use of the Directory or the insurance status of any user who access the Directory.

4. Affirmations

I am at least eighteen years of age. The information I submit relates to me and not to any other individual. The information I submit is truthful and accurate. I own or otherwise control all of the rights to the material I submit including, without limitation, all rights necessary to provide, post, upload, input, or submit the material. In addition to this agreement, I am bound by the Physicians Committee’s Terms of Use, which are hereby incorporated by reference.

5. No Employment Relationship*

I am not an employee of the Physicians Committee and shall (a) indemnify and save harmless the Physicians Committee from any liability arising out of my misconduct or negligence in performing under this agreement or otherwise, and (b) not hold myself out as an employee of the Physicians Committee.

* Not applicable to health care providers employed at will by the Physicians Committee.

6. Privacy

I shall not submit to the Directory, or otherwise use or attempt to use the Directory to disclose, any protected health information, as defined by the Health Insurance Portability and Accountability Act. The Physicians Committee maintains personal information in accordance with the Physicians Committee’s Privacy Policy.
